Update on Military Absentee Ballot Issues in VA

After Brat diligently posted and passed on the information about the absentee ballot issues in VA I did a search and found an update. Of course, the information that Brat posted was right on the money. The good news to this story is the issues are being dealt with and it looks like the ballots will be counted after all.

I am pleased with what I read and it sounds like this group is not just counting on the problem being taken care of — they plan on following through and keeping a careful watch.

The following article excerpt is from The Atlantic:

…The problem is that the Fairfax County government had originally interpreted Virginia law to require all Federal Write-In Absentee ballots to have a witness’ signature, printed name and address on the Federal Write-In Absentee Ballot. However, the underlying Virginia law only requires this witness signature, printed name and address if they are taking advantage of the special Virginia provision that allows the Federal Write-In Absentee Ballot to ALSO serve as the absentee ballot application. Because that’s different from what the federal Voting Assistance Guide says, hundreds of Federal Write-In Absentee Ballots received to date were potentially going to be rejected. In fact, as of today, while about 260 Federal Write-In Absentee Ballots had been received by Fairfax County, only five had the witness name and address.

I’ve been in contact with the Fairfax County Registrar, Rokey Fulman, and he accepted my recommendation to contact the Virginia State Board of Elections to confirm this interpretation of the Virginia statute, as Sam’s letter points out the Fairfax interpretation is likely incorrect. I’m happy to report that he has received guidance from the State Board of Elections that the witness name and signature requirement do indeed only apply if the FWAB is also being used simultaneously as an absentee ballot application. Therefore, so long as a Federal Post Card Application is received by election day, the Federal Write-In Absentee Ballot will count, which is the normal process for military absentee ballots to be cast.

Hopefully this will allow for the ballots to be fully counted. National Defense Committee, through its Military Ballot Protection Program, will continue to monitor this development, take appropriate and forceful action where needed, and advise you all as to what we are doing. Source Link

    Hmmm, no wonder there’s assurance to build the inagural platform so early. And the lawsuit in Philadelphia asking for Obama to prove he is a naturalized citizen, and asks Obama to prove he is a legally eligible candidate, has been thrown out by a Philadelphia judge. Check out Breitbart.com. And an Orlando TV station is ‘banned’ from further Democratic candidate interviews d/t the audacity of asking Sen Biden a fews legit questions which the campaign felt were offensive. Uh, what’s happening to free speech?? Why aren’t our citizens putting the puzzle pieces together to see the bigger picture? We’re in for changes, ones people aren’t understanding or seeing clearly at this point. And that statement doesn’t touch on the economic or tax platform presented by the Dems. Guess I’m sounding just a little crabby this morning!! :~

    Seems to me, that if the US military can oversee the election in Iraq, we might do well to put them in charge of Nov 4th…

    SINISTER BEHAVIOR is nothing new with the DEMS who will do and say anything to get their “so called” CHOSEN ONE elected. The military vote is always challenged by the DEMS – you all know why……most of them will vote REPUBLICAN – DEMS know this and try to block their vote.

    Heh, the right thing would be for Obama to go ahead and tap out. He’s not even proven he’s an American citizen … jus sayin. :devildog

    Obama makes me think of the Temptations song ” The Great Pretender”.

    Obama is like a camilian, turns whatever shade he needs to suit the situation. Hum, could make a good video with Obama doing the singing.

    Even for those who dont want to vote for either canidate, they can write in their on canidate, like Chuck Baldwin of the Constitutional Party. Ron Paul is supporting him. It is the alternitive to the Independent Party. We all know that the Independent Party is just a little less liberal than the Democrate Party. Then when the final votes are in, the Constitution Party can throw in their votes with the Republican Party. In the end, we win! :lb

    All we want is less Government running our lives, but thank the LORD we have not been attacked since Bush took office. People need to be reminded it was only after the Dan Rather debocle that tried to close the
    election before it was finished and only 9 months later that America was attacked. How quick we forget. We don’t need Un Holywood running our Government and we know that Un Christian people support Obama.
    I don’t know what the title (Christian) means to some people. To me it says I am a JESUS freak! I don’t belong to any denomination. So I hope that whoever winds up as President knows Christ JESUS on a very personal level. Only Jesus can give us the kind of President we can be proud of and GOD will bless and bring our nation back to righteousness.
    So vote at least for someone, write in your choice whoever it may be.
